Accused of leaving scene of crash!!

I recently had a car crash with another driver who has refused to accept fault therefore insurance are now investigating. The problem is I’m now being called in for interview under caution for leaving the scene of the crash which I did not!

So I was driving home late from my parents with a passenger and on the way have been hit by another car which he is claiming was my fault. We both stopped and we were all fine luckily so we exchanged details. Whilst we were there he called two of his friends to the scene one of which was a very rude woman. We had exchanged details and I was in shock so myself and my friend walked back down to my parents but, i have now been called in for an interview because he has waited till we had left and then called he police saying I had not give him my details!! I now wish I had not agreed to not call the police cause I feel this was just a plot for him to make me look at fault for the crash! I’m so annoyed. As his two friends were there police are saying he has two witnesses but of course his friends are going to say whatever he wants them to say!!

@foxystoatfoxypig well maybe not but when in a crash if nobody is injured then there is no need to call the police and tbh I just wanted to leave.

My car was on a main road but some passers by pushed it onto a side road so it wasn’t obstructing traffic.

You walked off and left your car causing an obstruction? Confused

I realise a lot of people are getting confused probably because I have made it rather be confusing but just to explain.

I was in a crash and yes the car was bad but nobody was hurt at all so we were just glad to be OK.

The car looks bad because I have been going straight down a 30mph road when a car has drove into my path. This wasn’t just a little clip.

I gave the man my details and he did me but he’s saying I didn’t which is why I have to go into the station.

I didn’t leave my car in the middle of the road, someone pushed it onto a side road For me.

I didn’t call a tow truck because I don’t have the ridiculous money they charge.

Tbh I’m not sure why you didn’t think the police should be alerted to a crash that caused such damage and led to car/s having to be pushed off a main road (so as not to be an obstruction). At the very least you’d surely need to think about a recovery vehicle?

It could easily be argued that yes, you did leave the scene of an accident. Regardless of whether you exchanged details or just walked to your mums.

You are looking at it in the wrong way. By leaving your car you have actually left the scene of the accident. You hadn’t arranged for it to be towed or anything. You might not have run off without leaving details but you did leave

I’ve seen roads closed by the police fir damage to vehicles similar. There would probably be debris on the road too making it unsafe for other road users.

DH was hit by a lorry whilst on a motorbike and the police didnt come out because it wasnt serious enough apparently so I wouldn't worry about not immediately calling them. Have you told your insurer you've been called into a police interview? Many offer legal cover as part of a policy so may be able to provide support. Its certainly worth calling them. It all sounds a little odd although the man has acted strangely to and arguably it could be quite threatening for him to be calling his friends over whilst you are just there with someone elderly. I would be wary of him being someone who will be claiming whiplash etc next as a bit of a scammer especially if he just drove straight in to you.

The problem is not me leaving my car! It’s apparently not leaving details. And this guys car was not towed for days later. @MoveOnTheCards store it somewhere till insurance decide what’s happening. It is now stored in a garage yard free of charge and cost £20 to be towed compared to £250

@blackcat86 thank you. Yes I’ve let the insurer know and the police have only come I believe because he has said he’s been in a crash and the person has fled the scene. I just don’t want to be getting a criminal record/fine/ban or anything for something I haven’t done. And yes it was intimidating when he is getting his friends to turn up. I just feel like he has pulled a fast one on me. Now I am the one having to go down to the police station and the one having to fork out £310 for my car. My insurance won’t cover me unfortunately

But you’d still have to arrange getting your car from the road to a garage/storage.

You can show you exchanged details, but your post (and title) claims you’re being accused of leaving the scene. Which you did. Confused

If you're in the UK then your insurance absolutely does cover you for recovery of your vehicle after an accident, regardless of whether you have a breakdown/recovery policy for other circumstances. You were irresponsible to leave the scene/abandon your vehicle without arranging this and although it sounds like the other party is lying, you really haven't helped yourself to look innocent through your own actions here. All you can do is speak to the police, be honest and hope they believe you.

@moveonthecards yes I would have but I couldn’t do that at night as the person who towed for me doesn’t operated 24 hours. And leaving the scene is leaving without giving details. Exchanging details and leaving is not illegal

OP it looks like you ran into the back of the other car? To comply with the law, you need to give your name, address and insurance details.

Yes, but not before the claim has been investigated and who was at fault has been decided and agreed.

In this case she said the driver pulled out of the side road into her.... so yes the insurers have to decide but it's fairly clear cut. I had this exact situation happen to me. There was no insurance issue and my car was towed to the garage

OP the damage seems to be at the front of the car, if he T boned you coming from a side road, surely the damage would be to the side?

Did your friend not have a working mobile phone to take his details either?
