Accused of leaving scene of crash!!

I recently had a car crash with another driver who has refused to accept fault therefore insurance are now investigating. The problem is I’m now being called in for interview under caution for leaving the scene of the crash which I did not!

So I was driving home late from my parents with a passenger and on the way have been hit by another car which he is claiming was my fault. We both stopped and we were all fine luckily so we exchanged details. Whilst we were there he called two of his friends to the scene one of which was a very rude woman. We had exchanged details and I was in shock so myself and my friend walked back down to my parents but, i have now been called in for an interview because he has waited till we had left and then called he police saying I had not give him my details!! I now wish I had not agreed to not call the police cause I feel this was just a plot for him to make me look at fault for the crash! I’m so annoyed. As his two friends were there police are saying he has two witnesses but of course his friends are going to say whatever he wants them to say!!

Okay, I wasn't expecting that level of damage. Tell the police the truth and if they lie about the whereabouts of the witnesses this can all be proved with technology. How did the crash happen? Is there a reason he's trying to pin it on you ie. dangerous driving?

Remind the police he texted you his details after the event.
He has a contact number and yes tell them you told him , but left after he called his friends as you were outnumbered and being threatened.

A bit odd that you didn't take his details down on your phone! As a PP mentioned your phone will show where you were. Do you have a fitness app on it? That might show the time you started walking.

My phone battery died therefore I couldn’t take his details and put them in my phone and I didnt believe he was going to lie about anything as he had told me his name and his address already which was an easy address to remember. Also he was with the same insurance company as me. To be honest this is the first crash I have been in and it was all a shock so I didn’t think too much of it all at the time. I should have probably done many things differently like perhaps call the police but as stated above by another poster they don’t always come out anyway as nobody was injured. And with regards to a tow truck I was going to deal with it all the next day

My only thought then is that I would have waited around until I knew what was happening with the (dead) car instead of just leaving it abandoned on the road. Is that why the police want to speak to you, do you think?

I know your phone had died, but when I was in an accident I borrowed a phone to call my insurance/breakdown etc and they sorted it all out there and then. I waited with my car until a tow truck arrived, the tow truck dropped me at the place where I had a hire car waiting (organised by insurance). Then I just let insurance do everything.

Nope, not buying it. He had a name you couldn't pronounce, but later his name and address were easy for you to remember? If you didn't leave the scene then I'm sorry that circs are such that it's easy to disbelieve you.

@PuppyMonkey I’m not covered by my insurance for recovery so I had to organise that myself but I wasn’t just going to get the car scrapped as recovery charges are high. It’s because he said I left the scene of the crash. @BuckingFrolics I never said I could remember his name. I still couldn’t tell you his name at all, his address on the other hand i know someone who lives on the same road and it’s in the area I grew up in so not hard to remember at all

And just to add the tow truck that took my car cost £250 just to recover the car plus compound charges. When I arranged for my car to be towed from the recovery centre it cost me £20 but they don’t run 24/7 therefore I couldn’t get them to tow my car at that time so was waiting till the next day. It was also about arranging where the car was going to be stored afterwards which it is now being stored in a garage yard for free rather than the £20 a day charged by the place that had my car

Actually you should always call the police after an accident, 999 if its an emergency situation, 111 if not. I didn't know this and assumed it would be a waste of time for an accident where no one is injured and the car isn't causing an obstruction on the road. I think the fact that you walked to your parent's before your car was removed is probably a bit of an issue, but a solicitor will definitely be able to help.

@FAQs nobody was seriously injured, my elderly friend felt it afterwards though but nobody wanted an ambulance. We were all ok luckily
@Luzina I called 101 the next morning and was told police didn’t need to be involved if we had exchanged details

He texted you his details the next day. Clearly you stayed around and exchanged details, because he had your number to do this.

Also the only reason my car was towed was because the police believed I had fled the scene without giving my details. The other guys car was left in the same place his car had stopped

I wouldn't have left the scene if my car looked like that without ringing the police first. It's not just a little bump. The whole of your front end is caved in and the airbags have gone off! It was dangerous to leave it on the roadside even if you had moved it.
I'm not sure you can get out of this pickle OP unfortunately. You may not see it as leaving the scene but I'm pretty sure the police will feel differently.
