Charges against property

I am wanting to buy my xp's share of the house as I want to separate. He, however, does not want to, and although he has agreed in principle he has said he will not actively facilitate any of the process. It should have been relatively straightforward but after checking the Land Registry it would appear that there are 2 charges against the property in his name.

I do recall years ago being informed as I was entitled to know being part owner of the house but he assured me it had all been dealt with.

I now need to know the exact sum owed so that I can ensure everything is paid off out of his share of the equity before putting the house in my name only. Will the companies concerned communicate that info to me as I am not the debtor? I know for a fact he will refuse to investigate and I don't know where that will leave me!

You can’t do it as simply as you think. Unless he gives your solicitor authority to deal with his creditors he’ll have to appoint a solicitor who will have to secure the repayment of the two equitable charges out of what you pay him.

Are you certain loans are in his name only

Definitely in his name only. I've looked at the Land Registry document
