Interstacy

Complex question, hope someone can help.
Relative has died with no will. Her closest family are nieces and nephews. One of those nephews died young, leaving children.
My question is, will the children of the deceased nephew get his share, or will it be split between the three surviving children?

Google “rules of intestacy”

KnickerBockerAndrew · 16/01/2020 20:23

I have done. It's unclear because this is quite complex.

If you're in England and Wales the children of the deceased nephew will get his share split between them.
The law may be different elsewhere

BumbleBumbleBumbleLies · 16/01/2020 20:26

It will still be split 4 ways. The share due to the deceased will be split between their children in England/Wales

I agree, the children of the deceased child will get his share split between them. so 25%, 25%, 25% 12.5% and 12.5%.
