Ohhhhh nice
My soon to be EX ( granted first part of divorce after he told court he wouldn't sign papers ) of TWO AND A HALF YEARS... has just opened a court case saying IM ABUSING OUR CHILDREN ( 13 & 17 ) mentally, physically, emotionally and psychologically... because after a 20 year marriage, I get diagnosed with brain tumours and my personality changes.... he then sh*gs about and ends up getting a 'lady' pregnant, whom he now lives with.
He hasn't paid a penny child maintenance,
and he has committed many different frauds while taking my part of business income.
Thing is, because "he got in first" at the Family Court ... chances are they wont listen to my side and will not see this for the vexatious provocation that it is.
It's now Christmas Day ..... I cant phone my solicitor ( whom he us making me spend thousands using ) and I'm in utter pieces.
I'm not the one in the wrong ........

You don't say what he is asking the court to do. However. the court don't care who got in first. They will listen to your side. They will also listen to your children.

Your children are old for this to be about contact or residency. I'm not a solicitor like prh47 but I have been through the family court several times and it doesn't matter who made the application. Do try not to stress about it and let it ruin your day.

It doesn't matter who got in first with the application, the court will not care and will listen to you. I know it is hard but try not to stress.

What do your kids want? At their age, their wishes will be heavily taken into account. Have they expressed a desire to live with their dad? How often do they seem him at the moment?

Thank you all for your response. I'm not altogether sure what he is asking ... he says there is contact problems yet he and the kids know that I have always done exactly as he wants because it's easier that way. He says because I am not working .. basically I can change my days at his request to accommodate his and his new gf's job! Then in the next breath he wants 3 days in a row. I dont want this .. but kids say they do .. so I go along with it then ex keeps changing it through the kids as he wont text me directly. ... they really have no idea what he is doing and he's telling them I'm keeping all the money from him and im abusive to him... its all lies ...

So he's texting your (nearly adult) kids to make arrangements that suit them all?

Sounds reasonable to me.

Totally fine. Agreed. So why a court order when its working in his favour anyhow. Its ridiculous... its just to get me to spend money on a barrister
