Shared parental leave issues

Hi,

I am half way through my maternity leave.
I was supposed to do shared parental leave with my hubby but hubby went off sick and therefore was unable to share it with me.
Hubby and I work for 2 different companies.
My maternity pay will be reduced much sooner due to (unused) shared parental leave. Is there a way I can claim the money for his unused shared parental leave back?

It says that once your curtailment notice is submitted it becomes binding and gives the (very few) instances in which you can withdraw it. Unfortunately I don't think your husband being off sick counts as he can still take his SPL and pay - I'm assuming the reason he's not going to is because his sick pay is higher than he'd get on shared parental leave?

Your situation has intrigued me so I've been reading (I'm a payroll nerd who likes answers!) It looks like, having curtailed your mat leave and created shared parental leave, you could theoretically take that shared parental leave yourself and receive the remaining weeks pay. You are supposed to give 8 weeks notice to take the leave though so not sure if that works with your dates.
