Flooding

I bought a house last year, the vendor did tell me that occasionally during heavy rain that the bottom of the garden flooded. Nothing was declared to the solicitor other than this. Last week the house flooded. 4 bricks high so all of downstairs. I have also found out that the vendor had a massive insurance claim a few years ago due to flooding. This wasnt disclosed. I will be speaking to my conveyancing solicitors tomorrow but is there anything I can go back to the vendor with?

The solicitor you'll be speaking to tomorrow will have the answer to that won't they? We could only speculate here.

It should have shown on the searches, have you checked those? If you could not declare previous occasion are you insured? Did your insurance company double check?

I'm aware of that. Speculation is fine. But someone may have first hand knowledge...

Seller would have to had stated on the sellers form about insurance claims and flooding incidents.

If he didn’t declare you can legally sue him.

I have some peripheral involvement in flooding, and know that there is a reluctance for property owners to report internal flooding, presumably because of the impact on property value.

Not in flood zone according to searches. Probably not relevant but the man I bought off is incredibly wealthy and this was his parents house. I offered way below asking price and he almost bit my hand off. House had been on market for 12 days

I'm surprised you didnt have problems getting insurance yourself if a substantial claim for flooding was made

My solicitor has looked into it and I have an appointment next week. Fingers crossed it gets resolved quickly

So probably pluvial (run off) rather than fluvial (flooded watercourse ). Hence it not showing on your Searches.

Check with your neighbors for any previous occurrences. Also check with your local council, Building Control or Environmental Health may have some info.

Any new developments which could have diverted water to you?

Any blocked ditches which would normally carry run off?
