Breach of contract

I had a builder install a walk-in shower and tray. On his estimate and invoice he said he would replace two rows of tiles above the tray. He didn't do this but still wants full payment. Is he in breach of contract?
He is taking me to the Small Claims Court.
I have only paid 50% Of the bill because I now have to have it redone. Where do I stand?

If he hasn't carried out all the work on the invoice he can't charge for it. If he won't fix it you are entitled to reduce the amount you pay him by whatever it costs you to put it right.
