DS1 - Charge on house

Hello!

I have a charge on my ex marital home. My exH will pay me to release said charge so then I can buy my own house. I need a DS1 form.
It appears that he needs then to get an AP1 and submit those documents to the land registry.

My conveyancer (for the house I'm purchasing won't deal with the DS1). So how many solicitors need to be involved? One for him and one for me? (We've received conflicting information about it).

I'm at a loss as this will likely delay the purchase of the house as well as the added expense. TIA

He should take independent legal advice, particularly if the amount he is owed is not certain / specifically stated in a way that is clear to calculate. If it is the land registry will still want his ID to be checked and this is usually done by a solicitor (other than yours) checking his ID and completing form ID1

His solicitor can draft the DS1 and AP1. You need to be happy with the documents, though they are very straightforward. If he has a solicitor an ID1 form will not be required for him as his solicitor will verify his ID and submit the application. You may need to get your solicitor to do an ID1 for you though. They should be prepared to do that for you for an extra fee (between £10-25) as they are acting for you in another matter.
