Any property solicitors out there? Need help please

Just in the process of purchasing a house, I've been sent out all the paperwork by the solicitors and one of the questions is do you own another property.

Now technically I do still own another property but only for the next few weeks. Do the solicitors do a land registry search on you to see if you own another property or is it just HMRC that is concerned about this due to the higher stamp duty?

Any help or info much appreciated!

Your solicitor will need to complete the return to HMRC so you need to explain about the other property and hopefully it will complete before at the same time as your new property. Otherwise you will need to pay higher rate stamp duty and then claim it back when your first property completes.

The property I'm buying is under the stamp duty threshold so just wondering whether they would normally fill out a return to HMRC with a 0 attached or will it be the case that they will need to send one now because there is another property in the background.

Can I suggest you discuss it with your solicitor? I expect it is to do with stamp duty but if you explain the situation to them then they can give you the right advice. If they don't know then they can't do the right thing.

Don't lie. Complete the form properly. The other house will sell before this one completes so you'll be able to claim the relief.
