Hello,

Don't want to say more than I need to, in the case I am outed.

If, as a professional, a former service user makes malicious allegations against you, leading to the stress of professional body investigations, can you take civil action against them such as a harassment order etc?

Any advice is much appreciated.

I don’t know. i assume it was proven malicious?

Potentially it could be libel?

You could probably only take action against them if the allegations were ruled to be unfounded / malicious following the investigation.

If the service they used is something related to mental health then you might struggle to prove it was malicious.

Assuming the investigations haven’t finished yet, I can imagine how stressful it must be for you, but try and remember that professional bodies are duty bound to investigate all allegations, and just because they are investigating it that doesn’t necessarily mean they think there’s truth to it. It might be worth seeing what the outcome is before you make any decisions about taking it further.
