Remove van from drive that has been parked there since dec 18

Hi everyone

My ex-husband who I am still living with has allowed a friend of his to park his van on our drive.
(My husband and I own the house together but he has only sporadically paid towards the mortgage and has not contributed to the family income since jan 2018.)

The van has not been moved since December 2018, it is in the way when I take out the bins, I cannot weed the drive under it and it looks really messy. Also there is less space on our drive to manoeuvre and park.

I have send my ex-husband and his friend many e-mails asking them what the plan is regarding the van but not have had a reply.

My question is:
can I have the van removed from our drive? What are the potential consequences?

Report it as abandoned. It isn't registered to your address...

Thanks for your suggestions. Could my husbands friend sue me if I got his van crushed?

Second checking if it's taxed or insured. Delay will try to contact them first before taking it away. We done it for a motor home that blocked loads of shared parking. The fit now has a caravan he parks there instead but at least it does move occasionally

Can you check the Tax / SORN status and report back.

I checked and it has its SORN but MOT expired 05 July 2019

Report it ASAP.

It’s in private land so what can you do? Have you got keys do you can move it onto the road? Or give friend 14 days notice that you’re scrapping it and it will get collected, though you need proof of ownership.

As ever there's a lot of incorrect and potentially damaging/expensive advice on this thread.

The car is left on your land. OP is the bailee.

You will have to follow the procedure set out in the Torts (Interference with Goods) Act 1977. No point me repeating the relevant parts of the Act here. Have a look on landlord advice sites too. They have to deal with this kind of thing all the time. there is a strict procedure to be used before you can sell the car to get it off your land.

Your ExH who still co-owns the house has given his friend permission to park there. I don't think there is anything you can do.

Thanks everyone for your comments, there is some really good information here and I knew there is not really a simple solution. I have given my eh friend notice and he knows I need the van to be moved so hopefully he will have the decency to do it.
