Ex refusing to sell or buy me out

I left my ex husband after domestic abuse several years ago. We have a child together who lives with me and doesn't want to see his dad.
I have been renting but am now in a financial position work wise to buy my own home however I do need a deposit. My ex still lives in the marital home (we are divorced).
I sought advice from a solicitor who has advised me that I am entitled to half of the equity.
At first my ex was fine to buy me out but is now saying he is ill and stopped working so can't afford to buy me out and doesn't want to sell. Can a sake still be forced if he has become ill?

Yes, it can. Is he just trying to delay? What does your solicitor say?

Yes go see your solucitor and force the sale before you waste any more money for you and yr child . He's is responsible for his own destiny now

Why the hell did you get divorced before sorting the property out? It's going to be a nightmare now.
I'm not being horrible, I suffered domestic violence with my first husband and quite honestly it was easier to sort all of this out legally before the divorce. He can just drag it out to infinity now and you might not get anything.

Aslo how did you get the divorce signed off without a financial settlement, the court is very hot on that, they normally will not allow a decree nisi to be granted without both parties agreeing a settlement so how did this happen?

Yes, thankfully it can be forced.

Half of the value of the house is yours and you're entitled to take it, either in a buy out or sale.

If he's going to be a dick about it, it'll take longer but you'll get there.
