Consent order - mortgage

Brief history

I left the marital home in March 2017. Ex moved back in after we split in Oct 2016. He took over mortgage payments.

We have shared custody of the children

However, he's lost his job, has no means of paying the mortgage. I know they will start chasing me for the payments.

I'm looking for advice on consent order. House is in negative equity, I tried to come off it back when I first left and couldn't for this reason plus he wanted to keep the house.

I can't afford to pay that mortgage as well as my own rent, I work part time.

Is it likely the consent order will be granted whilst he is unemployed. I don't want anything from the house. Just out of my name!

You will only be able to come off the mortgage if your ex can remortgage it in his name only - and if he’s unemployed the lender isn’t going to allow this. You need to sell the house - a consent order will assist with this if he is still refusing to prepare to sell.

The house needs to be sold.

Better to do it before the mortgage company repossess. How much negative equity is there?

Do check there isn't insurance that will pay for a certain amount of time as well but it looks like this could be the kicker to get things moving - But in the mean time you need to speak to the mortgage company and tell them the account is in dispute and speak to their disputes team to see what they can sort out
