Job Offer withdrawn after informing employer that I am pregnant.

Hi all,

I originally posted this on as a pregnancy thread. As the situation has evolved I have been advised to post on here. I was offered a job yesterday afternoon and although I know I was under no obligation to inform them, I told the employer that I was expecting in December. Since then I have had the job offer withdrawn as they felt that I “misled them” and wasn’t honest. Is anyone able to give me some advice if I were to take this further.

As someone that used to work in HR I am amused at those emails, such a goldmine of evidence. Just imagine her cringeworthy linkedin posts🤮 People like her are the reason companies need HR departments - honestly what was she thinking?

It doesn’t seem that they consulted a solicitor or even HR at all - else they would have settled months ago. They have absolutely no defence, the bluster about brothers and addicts will only make the judge roll their eyes.

And the fact that you weren’t able to find employment afterwards would be taken into consideration when your damages are awarded. You absolutely did the right thing here - the law was intended to protect us all from discrimination from shitty employers to begin with.

I'm amazed they haven't settled already, but good luck for tomorrow. I am so sick of shit employers - I was once asked in an interview who I lived with and what my 'situation' was. She then started talking about a woman who worked there who is coming back after six weeks maternity leave. Looking back I'm sure it was to suss out if I was planning to get pregnant and have a long maternity leave as I was in my mid 20s. It was only a couple of years ago too.

Good luck for tomorrow! I went through something similar with the tribunal in feb 2012. My company wouldn’t give me my job back following my mat leave. They wouldn’t consider flexible working either because “what if I had another baby”!!! I had all the evidence in e mails. Obviously they lost, I won and got a decent pay out. Also used representation through my household insurance. Was pretty stressful, but felt so pleased I’d gone through with it in the end...and not just because of the money.

At the end of the hearing they should tell you when to expect their decision, they won't usually tell you over the phone and will send their decision notice in writing.

Royal Mail is severely delayed with post atm so don't worry if you don't get the letter for a while.

I had a very similar case to yours, took over 2 years of back and forth & lots of pettiness. They initially offered me £100 to settle 2 weeks before we went to tribunal! Obviously we told them where to go.

Settled for a 6 figure sum the morning of the tribunal Smile

Don't worry about tomorrow. You have her emails. Read through them again. Read through the points of law that are on your side, and have them in front of you in a little list. That is all you need.

Good luck OP and well done for taking it to tribunal - this is the way that precedents are set and law is decided for future cases so it's so important to challenge bad employment practices like this and not let them get away with it. Do let us know how it goes!
