Wills and probate - name spelt wrong on will

MyNameIsArthur · 10/06/2019 19:44

My mum died 2 months ago.

My brother, who is an executor and beneficiary of my mum's will, has pointed out that his name has been misspelt on her will. He thinks this could be a big problem.

Does anyone know how this can be resolved quickly?

Is that the only way he's identified? Does the will, for example, give his address or his relationship to your mum?

If it clearly refers to him by, for example, specifying that he is her son or giving his address, the fact that his name is misspelt is will not cause any problems.

It says "my son xxxxxxxx" . So hopefully it shouldn't be a problem then?

In that case it is clearly him (as proven by his birth certificate!) so the fact his name is misspelt is not a problem at all.

It will just be regarded as a typographical error.

Brilliant! That will cheer him up! Thank you!

My DF put my old address on his will .I was an executor. Didn't cause a problem at all just put down to my dad's mistake .Solicitor said it wouldn't cause a problem and it didn't Smile.
