Taking paypal to small claims

I had a refund go through my paypal account from asos for a return but it hasnt gone on to my bank account. I've been waiting for a month now for it to show with no money in site. So my question is can i take paypal to court? it seems a silly thing to do because the refund is for only 40 pounds but they are refusing to help me.

It would cost £25 to make the claim online. I’m not sure I could be bothered for £15. I wouldn’t give up though: there are other routes. What do you mean by they are refusing to help you? What are they saying?

The claim fee is added to the claim, so the OP would get the original £40 plus the claim fee if she won. However, I think she first needs to establish for certain that Paypal has her correct bank account details and that the bank hasn't misplaced the money.

I've called them and every time is a different excuse on why i haven't got it yet, its my banks fault, its their error but now they are saying that its VISAs error because they had a bug in their system. I called VISA and they told me i was misinformed.
The last time i called they said to deal with VISA myself, they now have stopped replying to my msgs.
I don't have a lot of money so 40 pounds is a lot to me plus its the principal of it.

They do have my correct bank details and i've called my bank twice, they said its nothing to do with them. Its on paypal to deal with.

Is it showing in your Paypal account as a positive balance and you can't transfer to your bank or has it not shown up at all?

Would financial ombudsman help with this or speak to your bank about visa chargeback?

It would be appropriate to make a formal complaint using the Paypal complaints procedure. Once you have exhausted that procedure you can then go the financial ombudsman. For the amount concerned it will be easier for you to do this as the FO is free to you and you don't need to worry about court costs. Make sure you follow PPals complaints procedure properly though.
