Party Wall

We have a quote from a builder to do our front drive and part of the work required will be to remove a retaining wall on the boundary and rebuild as it isn't doing its job and retaining. We are also seeking to have the chimney removed in our lounge which attaches to our neighbours.

The neighbours are happy for us to do the work. I think we will need a party structure notice for the chimney and a line of junction notice for the wall.

My question is this. My builders (who I have used before for a much larger build so know I can trust them) have said that the have a gap to do this in 2 weeks time. Can my neighbours give written consent for the work to start before 2 months have elapsed on the notice (1 month for line of junction) or are the time periods inviolable?

They can give consent for any work to occur in any given time limit. they need not wait the whole month. Have you got Building Regs approval sorted?

Apparently building regs aren't needed as the upper chimney breast has already been removed in the past and suitable works have been done in the space above to support remaining chimney going up into the loft. Just the party wall agreement for next door. I could always double check.

Thanks for letting me know about being able to do sooner if they agree. My neighbours are elderly so I think I'll pop some paperwork over tomorrow when their daughter visits and get them to speak with her too / let her ask any questions as well. I don't want there to be any bad feeling.

If they want time to think and ask things I'd rather delay and not rush it!
