Hit and Run

Hello, my partner's car was struck on the passenger side door whilst parked outside our house and was a total loss just over a month ago. A Van further down the road was also hit, but only very slightly scratched. My partner received a phone call today from the insurance company telling us that the van driver has put a claim in against us as he is blaming us for the damage. However my partner and i had walked to our local restaurant with our dog for dinner and were there until well gone midnight we also met my friend. we found the damage to our car when we got back after walking home. The police were informed and photos were taken, we just don't understand why we are being blamed when we never drove the car that night. Any helpful suggestions as to what we should do would be very grafullly received. Thankyou.

Do you know if the van driver reported it to the police? If he didn't, then he would appear to have committed an offence. If he did and his version differs so wildly from yours, then there might be grounds for the police to investigate it - there are potential insurance fraud and/or perverting the course of justice charges.

If you or your partner didn't drive the car that night and had parked sensibly, then there's nothing to worry about. Tell the insurers, give them the crime number, and if you've got any evidence that you were out (receipt, credit card, copy of the restaurant's reservation book) then keep hold of it. It doesn't prove that you weren't driving, but it backs up your version of events. You also have your friend as a witness.

I'd be inclined to update the police as well, it shows you've got nothing to hide.
