Children and travelling

My children picked the children up as he is having them for the week

He told me that he won’t bring them back and I’ll have to collect them. When he moved almost 200 miles away, we agreed he would do all of the travelling as it’s his choice to move away from us

There are no court orders in place

I told him if he forces the issue and I have to get them from his house, it’s the last time he’s having them and he can take me to court

Does anyone know the legalities?

If there are no court orders he'll have to settle for the future contact that you agree with. I suggest you go and get them then negotiate from a position of strength.

The issue is that I’m on holiday and am due back just before the children would normally be dropped back to mine

If I went there after my holiday, I wouldn’t get there until 11pm and then would have a 3.5 hour journey home again

Then you'll have to go and collect them the following day. I'm not sure what else you think can be achieved.

I’m not sure that’s grounds for stopping your children seeing their father tbh. The contact is for the childrens benefit, not some privilege for the father that should be withheld as punishment for not sticking to agreements.

If he took you to court they may well say you should do half the travelling anyway.

Perhaps ask that he brings them back this time but agree to share the travelling in future.

The court might say that, but the usual starting point is the parent who moved away has to do all the travelling.
