Ex was going to spend some time with dd before we went on holiday and didn't return her - it's day 5 Sad I had no idea he'd do this as he agreed I could take her. He's been ignoring my calls and messages and I called the police that same evening, but all they could do was welfare check.
These have been 5 days of hell. I've contacted police, ss, hv, CLA, sollicitors, gp and all I hear is that they can't help me and that I should relax because my daughter is with her dad and she is safe. I've now applied for emergency child arrangement order. Anyone with experience of filling c100 and how long it takes for the hearing to take place?
Not knowing when I'll see my child again kills me!

My cousin went through something similar, after getting the emergency child arrangement order, she had her son back with her within 48 hours

You might be better posting in Legal Matters. I've only been involved in non-emergency contact proceedings so don't have experience of this.

I dont think you can kidnap your own child im afriad. especially if he is on the bc!

Is he on the bc?
Is there a child arrangements order already?

You can apply for emergency no notice hearings - you have to sit in the court and wait to be seen - but I've always been seen the same day

I think I've ticked the emergency no notice while filling out a form online and sent it off 3 days ago.
Anyone knows how to move/delete this thread? I've posted a duplicate in Legal matters.

If you want to move it to legal matters press the Report button (top right of your posts or in the 3 dots if you're on your phone) and ask MNHQ to move it for you.

I'm so so sorry you're facing this. Perhaps try Rights of Women for legal advice.

Contact rights for women but really you need a very good solicitor to file an emergency court order. It will not look good for him that he hasn’t returned her. Take this as a warning that you must now organise court ordered contact dates. He can’t be trusted to do what he says. Contact a solicitor now.

Rights of Women would suggest a good solicitor in your area while giving you an outline of what you can expect from the law.
