Hi
I started a job doing lone working which I have done successfully for years. Disclosed my mental health illness. After a week of working for this organisation I was sent to a private occupational health. At this appointment the Dr said no concerns and happy for me to work. However on the letter is said no lone working due to safeguarding concerns. My GP specialist CPN have all said they have no concerns and offered to confirm in writing. I got called in and they failed my probation and dismissed me as I wasn't fit to work. I asked would you accept a letter from my medical team and also bare in mind I've lone worked in this industry successfully for years. The answer was no, we don't have another role for you and we have to dismiss you. I'm utterly devastated because I loved it, because it isn't my fault I have this condition and I feel discriminated against. Have I actually been discriminated against? Could I take legal action, I feel as though I should take a stand against this particularly as it is a charitable health organisation who should know better.

You need to consult a lawyer who specialises in this area. It is not clear cut. In some situations an employer can give precedence to the views of OH over those of your GP.

Are you in a union , contact them or ACAS. How long have you worked there. Is the work likely to affect you mentally or physically.
