Mediation

Hi there, I reckon my ex is going to want to start mediation, it'll be our third experience in 4 years, which the last 2 ended in going to court.

My question is what are my options if I cannot afford the £300 fee of mediation as I don't qualify for legal aid?

I know if I "refuse' it doesn't look good on me if it goes to court but why should I be forced into debt again by my ex dragging everything through the legal system.

Many thanks

If you can't afford it then say so. Either he'll have to pay for it or it won't happen.

Thank you. Will it go straight to court and be told that I refused mediation?

That depends on your ex. Your ex can tell the court anything he likes. You will have your chance to respond/explain. If you say you're willing to do it but can't afford to pay for it that's not exactly a refusal is it?

No you are right. It's just I've been to court twice now and don't have much faith in the legal system.

In any case where there is a binary outcome one side will think they've won and the other lose. No one should think that if they don't get what they want then the legal system has deserted them. Learn to adjust your expectations to the reality of the law and take some legal advice.
