Illegal German Passport

Hi all, please help if you can.
I have a 2 year old with my soon to be ex. He is German, I am Scottish. Married three years.
He cheated so we have been split 6 months and we have a written 50/50 shared custody of DS
DS has a UK passport. My ex illegally obtained a German passport for DS without my consent so I am worried. My written consent is an absolute requirement.
Ex claims UK benefits as I earn too much. I suspect that he is claiming in Germany too (possible reason for the passport?). I have tried to get the german passport annulled but the system in germany is much different it is the local town hall that sorts the paperwork. My ex seems to know the local official and told him to ignore my complaint. I have tried the German embassy here but they say they dont want to get involved especially as i an not a german citizen. I feel like it is me versus germany.

The passport is not valid. It would need both signatures on the application form.
Do you want your DC to have a German passport? If yes, contact the embassy and report as stolen.

I would like the passport annulled at this point. I dont trust my ex. He obviously has a dodgy reason for getting the passport. I am at a loss as to how

Had the passport been issued?

Contact the embassy ... fill out the relevant form.
He can't really do that much with it. The UK and G will work together on should be try and get DC. Or he is just after a bit of financial fraud in which case, once again both countries will work together as you can only get CB in one country. The passport will only be valid for 6 years....
