New fencing help!!

Hi

My neighbours fence keeps falling down and we have just found out it’s our boundary wall!

Can we take down the fence due to it been dangerous and replace it with a new fence. Unfortunately my neighbour has dementia so we ask her n then she can’t remeber.

If the fence is yours you can do what you want with it.

If it's the boundary you're responsible for it's your fence that's falling down not your neighbours

Surely if it is the boundary you are responsible for it is your fence that is falling down regardless of whether the neighbour initially erected it?

Just double check it is your responsibility - look at the deeds and sometimes the side the fence posts are on can help decide. Mine is a bit broken in places but my neighbour has always said it was their responsibility and neither of us seems to be bothered about having it repaired at the moment.

If your neighbour has dementia hopefully there is someone around to take care of practical things for her. Could you involve them in the conversation so that you don't distress your neighbour by changing the fence (and therefore their environment)?
