Tolata case. HELP

Hello all. I recently split from my partner 9 months ago. We agreed to sale the house and go through solicitors to do so. On the day we was meant to do this she made false allegations against me and changed the locks. Since then I have had to pay the full mortgage and CMS payments I can’t not afford to buy two houses. She has ignored all my offers from solicitors to buy her share and has not once replied to my emails asking to sort this out. What will happen when we go to court to sort this out I want to sale split the equity 50/50 give the protected deposit back to my father and move on. She has said they won’t make he move or pay the mortgage because the little one is with her is this true

It's possible the court might agree with her but she'd have to show she can afford to pay the mortgage on her own, and the fact she agreed to sell up at one point will count against her. But it's not a question that can be answered on this forum. It involves a lot of law (despite what some McKenzie Friends like to think) and you'll need to go and see a solicitor for more detailed advice.
