Tier 2 visa/Divorce/Dependants

I am due to marry my DP this year. He is a non-EU citizen and currently is on a sponsored tier 2 visa. When he moved here initially he also had his wife and his DS (age 7) as dependents. As they have since divorced his ex wife is in the process of applying for a visa for herself and their DS is still attached to my DP's visa. We are going to have to relocate to another city in the UK due to DPs job. At the moment DP and ex wife have a 50/50 custody agreement (not court ordered). When we move my DP would like to take his son with him, understandably his ex wife wants him to remain with her. Does their son need to remain with my DP as he is attached to his visa? DPs ex wife doesn't earn enough to apply for her own tier 2 visa and is applying based on the fact her son lives here (this is what she has told us, I am not 100% sure of the details). Do they really need to go through family court to get this resolved as neither parent wants to live hundreds of miles from son. Or is this an immigrant/visa issue and the DS needs to live with DP as on his visa.

You won't like my reply at all.

I don't think your partner should move away from his ex when he has a seven year old to think of and shared custody.

I would triple check why he is wanting to marry you.

Sorry and I believe your ex should have contacted the home office as soon as his circumstances changed.

But your partner needs proper advice.

I just don't think your partner should take a job if the consequence is to try move a 7 year old child away from a mother (or father for that matter).
