My husband has received a court summons today for driving without due care and attention. The incident occurred more than six months ago. We were advised that if any action were to be taken this would have up be done within 6 months. Have we got this wrong? Thanks in advance for any help.

Thanks Zampa. I read that but it's well over 7 months since the incident so we don't know what to do. Seek legal advice I guess.

What does your husbands solicitor say?

I had no idea there was a time limit. If someone drives dangerously then surely it’s only right he is taken to court regardless of when it happened? Is it to stop things dragging on?

The question is whether information was sent to court within 6 months. The summons does not have to be issued in that time. The summons may show the "date of information". If that is within 6 months of the incident the summons has been issued correctly.
