Hi, ex owes over 1k in maintenance, we were with the CSA and it’s transferred over to CMS and earnings arrestment was in place again but they keep giving him chances to pay directly despite him never paying willingly all these years! Am I legally able to take him to court for the arrears now? As CMS are unable to collect it and keep giving him chances? Anyone know? I’m in Scotland. Thank you in advance.
