XH’s Solicitor - how to handle?

XH is represented for the financial proceedings, I am not.

XH missed all the deadlines for exchange of Form E and consequently I couldn’t produce a questionnaire. XH and solicitor turned up to the first hearing with a sparsely completed form E and a questionnaire. After the hearing, we agreed exchange dates for questionnaires.

However, his solicitor emailed me to say he was doing a new questionnaire and was waiting for approval from XH before letting me know exchange date. The next I heard from him, he said it was completed and could I exchange now. I explained that I thought we would be setting a new date and offered a week but he is now saying it is unacceptable to miss the court deadline by a week. I was trying to be flexible for him but he’s acting like I’m in the wrong.

At court, I found him intimidating - he was trying to force me to agree a lower valuation on the house.

How do I deal with him please? I don’t want to argue with him but I find his attitude unacceptable.

Just comply with the court order every time. When they don’t comply, write to the court.

Do everything by the book, do everything in writing, get everything in writing, only use the dates set by the courts, he has no authority to change them.

If you believe that they are not upholding the Solicitors Regulation Authority''s Principles you can report them to the SRA.
