I do have a solicitor but he is away on leave and I need advice ASAP.

I posted a thread yesterday but no replies. I will copy and paste it into this thread. But on top of that I now basically want to know if I can withdraw from paying half of these drug an alcohol tests due to the severe delay caused by my ex not taking the tests when ordered to do so. It is costing me £450 for him to do these tests and I am a single stay at home mother and my ex earns over £500 per week. 1) I can't afford it on top of all my legal costs aswell and 2) the delays are inexcusable and i am not prepared to pay it. The court had said to split the costs but I want to know if I have the right to now say no for the reasons I said.

I think he should pay, they are his habits! I will post yesterday's thread below.

Hi,

Can anyone tell me if they know how long it takes to get results back from drug and alcohol tests. It's for alcohol and 1 drug both are hair and blood samples.

Basically my ex was ordered by the family court back in August to do these tests and they still aren't done and we are back in court in 2 weeks. The court said at our last hearing just a few weeks ago they are to be done ASAP and they still aren't. He has delayed it for months. His solicitor has got a quote from a testing firm a few weeks ago but still no test even though spaces were available for samples to be taken.

I am so pissed off cos I have to stump up for half the costs and it's gonna be a total farce and will not show his true drinking habits. The court also said the results are to be filed with the court no later than the 16th November which is a few days before our next hearing. Up to now I have been asked for no money so I am assuming these tests are still not done.

Just wondering how long they take to come back and if it's likely the results will be back in time for the 16th.

Ok so I have just checked the quote and it says an overview. Does that mean it won't be segmented? That is really what I wanted as it would show his heavy use and then him cutting down after the court said he was to be tested. What will an overview show?

It is Alere Toxicology doing the tests.

Unless it says month by month or something? I don't know what else would suggest segmented as that's the word they use on their site

An overview will still grace the sample in terms of level of use. When it's bad they usually call it 'chronic and excessive' or 'hazardous'

I just googled the difference and this is what it said:

In a 6-month segmented analysis, hair samples are sectioned into six measured segments of 1 cm to provide six individual monthly analyses. As such, segmented analysis is especially useful if you need to obtain a trend in drug use, such as to see a decrease or increase, or to highlight intermittent use.

Deciding on which type of hair drug testing to choose in legal cases can have major implications. If a 3-month overview drugs of abuse test is selected, even if an individual uses drugs occasionally, the test may come back positive for the whole 3-month period. This result implies that the sample donor had been abusing drugs during the whole period analysed.

So basically even if he was drinking heavily before the tests were mentioned and he has cut down since it won't show that he's cut down it would just show positive for the whole time.

I wonder what they class as excessive.
