Moving abroad

Can anyone advise me where I stand moving to EU with my two young children? Was not married to ex. He picks and chooses contact though been more liable lately. I financially support us without his help. He’s just moved from round the corner to 120 miles away. If I want to up sticks and move to Spain, where do I stand?

How old are the Children? I remember somewhere on MN that if Children are under 16 they need permission from both parents to leave the Country? Citizens Advice Bureau may be able to help you?

Not really relevant to the question, but if father has moved 120 miles away its sounds like he is not very interested in his children?

You need his permission. If he has PR.
If he refuses then you need to go to court and ask for the courts permission. The judge will listen to both sides reasons for going /not wishing children to go.

My DH exW tried this. We opposed. Court case followed. DH won- children not permitted to go.

Will depend on numerous things.
Are you going to a Hague convention country.
Do you have family support there.
What type of schooling is available.
How often will YOU be prepared to fly them home for visits at YOUR expense.
How old are the children
Do they want to go.

@fontofnoknowledge has summed it up. Might help you that he's 120 miles away. Would the arrangements for contact be that much different if you were to move away?
