Hello 🖐 i need help! Ive sent a letter to Argos about my faulty iPad trying to get a repair or replacement using the consumer rights act (just out of warranty 😤 i used a Which template letter and sent it off. The letter stated they had 14 days to reply low and behold they haven't replied and now its over 14 days (by 3 days, i gave time for posting) but what do i do know? Surely there must be something they can't just ignore me so i cant do anything else? Can't find anything on the which website sent them a email but its a 3 day wait for a reply and im so impatient 😂 Confused

You can apply to small claims court online if they do not respond.

That's costly to me though, and if i don't win at the court ill be stuck with the fees, i was hoping they would roll over and fix it, its £260 to fix or £350 for the same ipad new its really annoyed me 😂

I think for that cost it is only £35 to take it to small claims but if you win then you would get that back.

I thought it was going to be £150+ i will look into court if they haven't replied by the end of this week i just want to start the proceedings for them to have sent the letter a few days late 😖

For a claim of £300 - £500 the fee is £35 if you file your claim online or £50 if you use the paper form. As the previous poster says, if you win you would get that back. If you lose you will not be able to recover the court fee but you won't have to pay any of their costs.

You can phone Argos and ask for their complaints procedure. Your letter has likely been treated as standard correspondence, with a much longer time to respond.

You can then take your complaint to the consumer ombudsman. Argos will be bound by their decision, and will probably attempt to resolve it before it gets that far. Every complaint that ends up at the ombudsman costs them circa £150 in fees; it's in Argos' interest to resolve it first.

Small claims court is probably overkill, as it's free for you to take your complaint to the ombudsman.

Argos is not signed up to the Consumer Ombudsman so that won't work. Their website currently only lists 22 companies as participating and many of these are not big names.
