First financial hearing

My stbx solicitor has requested evidence of my illness to prove I can’t work at the moment, even though he knows my health situation as lived with it for 20 years, he is clutching at anything he can to reduce my settlement, doctor says I don’t have to agree and he certainly didn’t agree, I have no problem them seeing it as it proves I am telling the truth, but having someone read your medical records is extremely personal and goes against my integrity, if I don’t give consent does it look like I’m hiding the truth, anyone else had to hand over medical records?

Why doesn't the GP write a letter rather than your records being handed over?

The hearing is on Friday have just received letter from his solicitor asking for records, GP won’t don’t write letters, I’m thinking I will let them have 5 years as this contains information they want. I have had to sell my business as I can’t work. He knows my past history and my fitness to work so this is just another thing to stress me out give up !

Well That's a new one on me.

Medical records are all very well, but is your ex or his solicitor qualified to understand them? Is the Judge?

It ought to be a gp letter. Why doesn't he write them? I've never known a go refuse that. They want paying, of course. Is that the issue?

No I have offered to pay GP just said we don’t write letters! I’m speaking to the practice manager tomorrow so I will ask again already put it in writing, I have asked my solicitor for advice. I’m just appalled that he has asked for this. But I have learnt that all bets are off during divorce, even when you’re the mother of their child..

Could you obtain a copy of your medical records and get a private GP or occupational health professional to read the notes and write a letter? I’m not sure if you could do that in time though.

That’s a possibility I am sure the judge will understand having only received the request on Friday thank you hadn’t thought of that, can’t bare the thought of them trolling through my personal file doesn’t help that his new partner is partner in law firm he is using..

OP you don't have to provide any of this unless and until the Judge orders you to.

This isn't a problem you have to resolve right now.

Thank you, yes unprofessional! Nothing I can do as it is not class as conflict of interest because it is the family law solicitor in her firm she is the criminal lawyer and partner!

My ex produced a letter from local GP that she hoped would get her Joint Lives Spousal Maintenance. To my astonishment GP wrote a letter stating that ex had had a chronic back problem for 9 years that prevented her from working and was soon to be X-Rayed and Scanned.

Complete nonsense as ex had not been in UK for 9 years so no way could GP know about such problem. That she had been attending a local women only Gym and was working 18 months prior to Final Hearing soon convinced Judge that GP letter was wrong and more likely a case of Ex self reporting and GP making some easy money.

Maybe GP in this case has been rumbled in the past and does not want to be caught out again?

2 years on ex is still working and attending the Gym proving that the GP letter was just a scam.

Forgot to add:

No mention on Ex's Form E about a back problem that prevented her from working. Judge soon saw through that one too.

These people problems to genuine people! My ex lived with my illness for over 20 years he just doesn’t want me to have anything when all I want is my fair share, I left because of his behaviour. Now he’s just extremely bitter even though he has moved on with his life still in the marital home good wages new partner, he has destroyed me!

Based on my own Divorce I would say Judges are good at working out who is the one being truthful and who is not.

No I sold my business due to ill health he says we sold at a loss, I have a business partner, they ordered my money into my solicitor bank account ordered pension to be valued , which I agree on but he agreed because he says some were started before we married, now he’s trying to limit what I get from that as well! We were together 22 years married 11 years, I can’t work due to health reasons which is why we sold the business, trying to get some benefits today, no income no savings, he has the house good income and 50k out there somewhere that he hasn’t disclosed yet , I’m screwed just want to give up it’s a joke x

In the absence of any proof Courts unlikely to take your word.

How long ago did he receive? Might have spent it by now? However, still worth presenting the evidence you have.

3 years he’s not the type to spend it ! Spent some on luxury holiday but he’s a saver have it stashed somewhere!
