Zero hours contract

I've just started working in a bar/restaurant. It came out yesterday that I'm on a zero hours contract. So no guaranteed hours and no holiday pay ! This was news to me! Now fortunately today I've secured myself another job which has proper contract etc. I will start this next week. I feel so conned! Is this legal? They didn't tell me. I asked to have a letter confirming the Ts and Cs when i was taken on, yesterday I was told it would take a while. So I said I just want to know what my holiday entitlement is etc. That was then I was told the truth. Perhaps I should have insisted that I have a contract before I started, perhaps I was naive ? I'm a 50 something and not stupid! Feeling really down about this. Anyone know if this is legal? Oh, and to add insult to injury our tips are put through our wages, so taxed! Minimum wage and bloody hard work! If I didn't need the money I wouldn't go in this week! Rant over!

No holiday pay is not legal. You are probably classed as a "worker" rather than an employee but that still gives you certain legal rights. You start to accrue holiday pay entitlement as soon as you start work. If you work irregular hours this should accrue week by week as hours to be taken.

Thanks Alexander. How do I find out what I'm classed as? I'm only working here for a week, but it's the principle!

Gov.uk website gives definitions.

It's right that your tips are taxed. At least they're doing that right.

cloudtree · 17/09/2018 13:57

Zero hours workers are still entitled to holiday pay.

cameltoeflappyflapflap · 17/09/2018 13:57

You still accrue holiday pay on a zero hours contract.

HoleyCoMoley · 17/09/2018 14:04

I got paid a bit extra each hour over the normal rate when I moved onto a zero hour contract to cover holiday pay

AlexanderHamilton · 17/09/2018 14:16

Rolled up holiday pay is no longer legal holey.

HoleyCoMoley · 17/09/2018 16:16

Oh really, I wasn't told that, do you get any holiday if you're on a bank zero contract

www.gov.uk/holiday-entitlement-rights/holiday-pay-the-basics

There is a grey area if your payslip shows the extra holiday pay amount separately.
