Deceased parents account

Hi all,

Myself and my only sibling have been given a private grant to act as the administrators for our dm's account. Our df has also passed away.
We theoretically now should be able to go to the bank and access the money split between us.
There are no dents that need to be paid and no other next of kin.
Our mother died in a care home so she was receiving some DWP benefit and her nursing and care home fees were all paid by NHS.
There shouldn't be any monies owed to DWp and we have not heard from them asking for any monies back as she was entitled to it at the time.
I think we are just scared to spend it incase one day we suddenly get a letter saying actually we shouldn't have paid you X y z can we have it back please.
Are we right to be concerned?

Sorry for the loss of your DM.
When did your mum pass away and did you inform the dwp straight away regarding her death.
You/ the executor can always call the dwp and mentioning her NI number ask them for a written confirmation that no funds are outstanding to your mum from them or vice versa. I assume you have no other debts to worry about.

My mum died in May. DWP currently has a backlog for death cases so we are waiting for a letter regarding overpayment....

Sorry for your loss.

The DWP will confirm whether anything is owing if you write to them, then you won’t have to worry. Very likely they would have told you by now but best to check so you’re not worried.

They don’t have a backlog that long! They’re fobbing you off there, I’m getting repayment requests through about 3 weeks after death at the moment. When have they said they’ll write?

DWP reclaimed some pension from my Mums estate, so it might be worth just hanging on, or keeping some money back.

I know that they're not fobbing me off due to insider info. Other people's cases may be more straightforward.
