So, my partners child has come to live with us, which he is under social services as his mother is unable to care for him.

The social worker came to see us yesterday and said within a couple of weeks the child’s case will be closed as they are now happy for his safety. Which is great.

My partner would like to have full parental rights eventually and full custody of the child due to the circumstances and situation he’s been in.

The problem we have is that he is not on the child’s birth certificate however he did have a paternity test when the child was a few months old which proved he was the father.

Where would he stand and what steps will he need to take to receive full custody, as I have read that he has no rights with not being on the certificate

He needs to make several applications to the Court, all together.

  1. Parental Responsibility in form C1. Court fee £215.
  2. Child Arrangements Order that the child live with him in form C100. Another £215.
  3. If he wishes (this is optional and the mum may agree so worth waiting) an application for Declaration of Parentage which once granted will enable him to have himself put on the birth certificate as dad. Can't remember the form or fee off the top of my head.

He also needs to complete C1A to outling the mum's difficulties.

4 sets of each form to court (ieC1, C100 and C1A and the court will order police and social services checks and list for hearing.

Obviously a solicitor would be a good idea but if you can't afford one just DIY.

Court fee remission for low income is form ex160.
