Can they sue us?

We returned from holiday this week to find that our cat had escaped from the Boarding Kennels two days before we got back.

We have put up posters around the village that the kennels is in, plus some more further afield. The poster says:

LOST CAT (pic of cat) 'Cat's Name' escaped from 'Kennels Name' on Sunday 19th August 2018 etc

The owner of the cattery is saying that we cannot name her business on the posters and she will be talking to her lawyer on Tuesday. We haven't said anything negative about the business, just stated the fact that she escaped from there to give an accurate reference point to where she went missing.

Does anyone know where we stand legally on this? Do we need to change the wording and remove the business name?

No MountainPeak, our cat is still missing. We've been out everyday looking for her.

Put a link to your poster? There are bound to be MNers in the area who could keep an eye out.

MarthasGinYard · 30/08/2018 09:42

No she can't Op

But you can pursue them

I'm on your litter tray thread devastated for you you've not got him bk yet.

Spoke to our local cattery about this. Lady admitted that one escaped about 5 years ago. They set up night cameras and cctv and got him bk.

LutherRalph1 · 30/08/2018 09:44

Obviously getting your cat home is most important, but I hope they'll be refunding you

MarthasGinYard · 30/08/2018 09:44

Op have you contacted local Cat protection/rescue

Ours are amazing at locating lost pets it's such a huge network.

strawberrypenguin · 30/08/2018 10:01

No they can't. Your posters are factual. I'm appalled they aren't doing more to help you find your cat, they should be bending over backwards to help. In fact you'd be far more within your rights to sue them than the other way round.

Hope you find your cat soon.

Whereisthecat · 31/08/2018 22:22

MarthasGinYard, that's not our cat on The Litter Tray thread. Sadly someone else is going through the same thing as us. I'll take a look & see if her cat is home.

I’d be taking a claim on her.
Have you reported her to EH?
I think you’re being very fair and calm towards her, i don’t think i would be!
I’m keeping my fingers crossed for you Flowers

Whereisthecat · 31/08/2018 22:47

Thank you MrMe. Smile

Goodness Op I'm so sorry I just presumed it was same case.

2 cases in as many days. Some real negligence out there in the world of animal care

I hope you get some good news soon

Awful

Whereisthecat · 01/09/2018 22:13

It's awful to think someone else is going through this nightmare too. I keep checking the other thread for updates. We are out every day looking for her, working on the assumption that she will be heading in the direction of home. I worry that she may have gone off in the opposite direction and we're looking in the wrong places.

Does she use a litter tray, putting that out could help?
Or put her bed out too.

Whereisthecat · 03/09/2018 19:02

Thank you fuzzyfozzy, we've put the tray in the garden and dirty washing hanging out there too. She doesn't have her own bed, sleeps all over the house.

No news of the cat on the other thread yet :(

Someone local to me lost their cat at the vet's car park. He lives a good hours drive away from the vet. Six weeks later, cat turns up. He said he drew a straight line on a map from the vet's to his home, and she was found in a small village directly on the line.

Last year, my cat wandered off for three months before turning up at the window two weeks before Christmas.

They're amazing animals, so try to keep hope.

Fingers crossed for you and her.

Whereisthecat · 03/09/2018 22:34

Thank you so much Repeal. I get really encouraged when I hear stories like these. We've focused our search on the assumption that she's heading towards home. Just keep hoping to get a phone call to say she's been found.
