My husbands ex partner has been refusing to give an address for the divorce petition because she wants to use a solicitor and wants us to pay for it. We can not afford this and don't see the need to do so given that there are no children, property or money to share. She was abusive in the relationship and continues to be. It has been four years and she has kept her address well hidden.
We came upon the address eventually, and got a court order to serve petition to this alternative address, which if she does not respond in 14 days leaves us with the option to instruct a court bailiff or apply for deemed service.
The sealed petition was sent last week signed and tracked and she has signed for it. I imagine as ever she will continue to ignore it.
Is her signature from Royal Mail tracking at her address enough proof for the court to deem the petition as served?
