Separation- unmarried, three kids and one on way

Hi, just wondering if anyone can give me any idea where to start with a separation.
We are not married, have a joint mortgage and have three children and I’m 26 weeks pregnant.

I need to secure our house for the sake of my children to stay in their school. I couldn’t afford to rent or buy again if we sell up within the area and want minimal disruption for them ages 7,5&2.

I work part time self employed in the evenings so have a very low income. A few things I need to know.

How to apply for a settlement order for the house... do I need a solicitor to do this? How much this would usually cost.

I have looked into mediation but I personally can’t afford this and the advice I’ve been led to believe because my partner is living here on a good wage I won’t get legal aid.

Hopefully someone can give me some tips or idea of what I need to do please

Unless there is a deed of trust that says otherwise the starting point is that the equity in the house will be split between you 50/50. However, with children involved you may be able to use Schedule 1 of the Children Act and TOLATA to remain in the house until your children have grown up. Get proper legal advice.
