Hi

I’m in Scotland & have a legal separation. Date of separation now 2 years ago. I’ve paid for an online divorce (agreed in separation). Ex now saying he is not consenting (he has no choice though under Scottish law). He has involved a lawyer.

He emailed to request I supply his lawyer with some info. Current mortgage amount (fine), amount in my account at date of separation (fine), shared expenses (fine). However he wants my current income & outgoings. Why? Why is this relevant. I’ve just ignored for now as request come from him. Lawyer is legit, I checked.

In England you would have to supply that unless you both reached agreement without detailed disclosure (in my own case we only had joint accounts and knew every last thing about each other so it was never an issue). In England people seem to get away with being vague on these things. If he won't consent even to the divorce he probably won't consent to a financial settlement so it might have to end up in a court hearing eventually.

Thanks for the reply. Scottish law is very different I believe hence not understanding why when we have a legally binding agreement.

You need a Scottish lawyer then to come along who knows what compulsory disclosure of finances is due in Scotland.
