Hi, i am after some advice.
I have been having a battle with my management company about my responsibilty to pay.
I dont believe i have to, the management company beleive I do.
I have a map of my estate that is in my tp1 that shows no managemet areas. It turns out the housebuilder didnt use the full estate plan with the management areas in when constructing my tp1.
In my tp1 it does state that i am to pay for all sorts of things such as electric gates, landscaping, lighting (if any), it also states that of any reference to colours/letters should be a reference to colours/letters on the plan. If there isnt then the reference should not be taken into account in the construction or interpretation of this transfer.
The management company have told me that if that reference to colours or letters wasnt taken into account that I would be responsible. They also want me to ignore my plan in favour of their plan as obviously their map shows management areas.
They are threatening me with debt recovery action.
Is what they are doing legal? What type of solicitor would i need to instruct and how would i get them to court?
