Child arrangement order, now a restraining order. I have a question

So have had a CAO in place for a year with my ex. He picks dc up on time etc.
However since for a different reason I have had to get a restraining order. Which means now he gets his family to pick dc up.
Part of the CAO is that the dcs contact me every other day during the school holidays which was prior to the restraining order.

His sis has now told me the dcs won't be able to ring from his phone as he'd then be breaking the restraining order that was put in place after the CAO . Is this correct

I know he don't live particularly close to his family so I know he wouldn't go there to use their phones to make the call.

It's possible. what you need to do is try and get the non-mol amended to add "save for the purpose of facilitating telephone contact in accordance with para ? of the order of ???" - though it would be hard to police whether or not he actually speak to you.

How old are the children? Can you give them a cheap PAYG phone for use during his contact times, and you ring them?

Call records would show his phone number ringing yours so I can see how you've played into his hands somewhat. How old are the children ?

If there is a non contact order then yes, he shouldn’t be phoning you. You could claim he was harassing you, and he would be in breach of the order. As previous poster has said- is he old enough for a phone? Otherwise all you could do is request another family meme we give you updates. I’d contact a lawyer to see if there can be an amendment- but non contact usually means no contact- to protect you both.

Dcs are 5+6 so can't give a phone.
I literally cannot afford any more legal stuff he's played so many games costing me thousands.
His calls would show calling me. If he for instance dialled my number then left kids to the call I wouldn't mind but they're saying he can't ring and as regards to the CAO there's nothing they can do as the restraining order came after so that takes place

I agree they could have a cheap pay as you go. That's what I would do.

Send them with a PAYG. He can help them dial if necessary and hand the phone to them. As long as it comes back with them he wouldn't be able to use it to contact you when they're not there.
