Easement and Fence

Hello

Long story short, we bought a property 18 months ago and it was not disclosed by the sellers that the neighbour had been using our land for 20 plus years.

It looks like the easement will go ahead there is nothing we can do (apart from sue the sellers)

However it looks like the neighbour wants us to take the fence down that we have put up on our land. We have offered to put gates in the fence so he can still have exactly the same access albeit open a gate.

Can he make us take a fence down on our land? I have a 4 year old I want to keep safe and stop running from the back garden to the front.

If we had known about this agreement we would never have bought the property.

Provided the gate isn't locked that should be fine. a gate easily opened (I'm assuming they're accessing it on foot) is not a substantial interference.
