Caught for Fraud and arrested yesterday

No excuses as I was caught red handed doing something I really should not have been doing.

I have been wrongly claiming whilst working due to a lot of money issues and now need to face the consequences of my actions.

My recent past caught up with me late yesterday evening when I was arrested at my workplace just before finishing my shift, I then had to go to the police station and have been in there til an hour or so ago.

Scared I will now end up in prison though if I do I know it is self inflicted, looking for any advice.

Ouch, previously interviewed and denied it, carried on claiming and then admittance. Follow Avasaralas advice now so that you can start preparing, with their advice how you intend to pay back the £12k

Gosh that’s a long time to keep you in over such a charge! How long were you in from yesterday Shock? I assume if you finished work at about 5.30pm, seems ott to have kept you in about 15 hours!

Yes this only happened roughly at about 8pm last night when I was finishing my shift.

I have already mentioned I have failed to declare which will work against me I know.

I was arrested once ( then dearrested as they had the wrong person!) But I was kept in over night, as there were more important people to deal with and as it was a minor offence I basically got pushed to the back of the queue!

Was only about 8 hours in the cell, the rest was questioning and being processed etc.

The public and government are sick to death of benefit fraud

Personally, I’m sick of people committing violent crimes and getting a slap on the wrist for it, while the working poor are given inflated sentences and completely disproportionate treatment for trying to survive any way they can.
I pay tax, but I can’t get worked up about the tiny amount of benefit fraud that goes on. More benefits go unclaimed than are claimed fraudulently so realistically nothing has been taken or stolen from anyone else.
And usually it’s working class women committing it to keep their family afloat.

OP, I’m sorry you’ve found yourself in this position, it must feel a bit surreal at the moment. Please make sure you get a solicitor asap.

I’m surprised there was no warnings. The amount of people who get their benefits stopped at the merest hint of foul play, yet they rather continue to pay you and play some odd game of cat and mouse for months instead.

Very surprised at Scottish Police doing this.

Best to just get your solicitor on it, with the best will in the world there's unlikely to be a Scottish law expert on here.

You should have been offered access to a solicitor as soon as you stepped foot in the custody suite. You should have been informed of this right.
This doesn't seem right- you need to refer to PACE asap.

I'm really sorry.you did such a wrong thing.but I feel for you so much.have you support. you sound scared.i know whats happened is awful for all concerned.but now you got to work to move forwards and how to do that with a clear head.with support.
we all fuck up.come on.some more than others.
are some people huge f*er uppers and not bad people.yes.
so what next?
are you remorseful.ashamed?
maybe write a letter to the police showing this.make sure you show your sorry.explain.dont lie.not even white ones.they will have EVERYTHING on you now so too if they have followed you will have every nook and cranny covered to put everything to its fullest punishment.
I am so sorry though because it must be overhwleming and frightening now.
any friend or family that can come and talk you through it.
have you ways forward.to pay it off,community service.debt plan.be proactive show them ur sorry and realise the error and want to fix this.
a solicitor I'm guessing will be helpful because they will no the next paths that will be taken and will be able to guide you through it without the emotion you will bring which could cause you to act irrationaly or different to a clear head someone neautral would bring.

I was offered access to one though like I mentioned in a previous post.

At the time I was naive in thinking it would help me as I know I am guilty as sin.

She was offered access to the duty solicitor, but declined.

Blanche, PACE does not apply in Scotland and anyway op has said she declined legal advice.

Oh, apologies. I caught the posts about finding a solicitor and wondered why you hadn't already spoken to one. Missed the Scotland part aswell, sorry!
Debbie, you may have been caught red handed but please still take a solicitor's advice. You've had harsh treatment so far, disproportionate to violent criminals.
I can imagine you feel sick right now, best wishes.
