Splitting from partner need advice please!!

Hi,

I have been in a seriously controlling relationship for the last 3 years, a year and a half ago we brought a house (shared ownership). The mortgage is a 3 year fixed rate so I believe there would be a hefty fee to leave the mortgage early.

Only problem is is that he will not let me sell/leave him and has said he would refuse to sign anything. I’m currently back at my mums due to his aggression and behaviour but I need to seek legal help into how I can get out of the mortgage if he is not willing to comply.

He is also holding my dog and won’t let me have her (she is registered in my name)

Is anyone able to advise me on what I am able to do!? I’m so desperate to get away from him and just feel so trapped. I can’t go back as he became abusive so that is not an option.

Talk to police about the dog and the abuse, they may help.

Long term you need to talk to a family solicitor about the property. Ultimately the court will force a ssle if you apply under the Trusts of Land and Appointmdnt of Trustees Act (TOLATA) but it is complex and you may need to consider whether there might a negative equity if there's a hefty mortgage fee.

Is he paying the rent and mortgage?

Yes we pay 50/50 on all the bills. However all the bills come out of my bank account as he didn’t qualify for the joint account so it’s only in my name! Not sure where I stand legally on this matter!

If you aren't living there you should get your names off utilities, council tax etc, but the rent and mortgage must be paid, or your credit rating is gone, and the place will be repossessed.

Is he currently paying nothing towards anything?

He is still paying his half of the bills but all the bills come out of my bank account so I’m assuming that I can’t just cancel them? I need to speak to citizens advice and see what legal aid I am entitled to, such a headache! Thank you

if he didnt qualify for a joint account how did you end up owning a house with him?

Because we applied for the joint account prior to owning the house, his credit rating improved by the time we came to buy

I think Legal Aid might not be available. It is certainly not an entitlement for anyone much these days.
