Stbxh won't complete form e or engage at all despite 6 months of trying I think I need form a to issue at court for financial hearings but I'm not sure which orders I need to tick on the front boxes? There's a house and pension but that's all to consider. I

Tick them all apart from maintenance pending suit (unless you want an interim maintenance order, in which case tick them all).

Thank you - is maintenance order for me or children? I won't get any spousal maintenance, but he refuses to pay CMS for the children too?

Child Maintenance is the sole preserve of the CMS unless he is abroad, or a stepfather, or other unusual exceptions.

CMS need to put him on collect and pay. That'll learn him.

Thank you! CMS are trying to do that apparently, but he had his own business so takes the tax limit as salary and rest as dividends, filing his accounts 2 years late. I'm screwed. Yet he drives a Range Rover and has had 3 holidays so far this year with new girlfriend.

Can I ask for/get costs as I am only issuing proceedings because he refuses to cooperate?

No you aren't screwed, they just have go take an extra step go include his dividend income. They will get there.

Costs on the financial application are usually paid by the party who incurred them. Costs are generally only ordered to be paid if there is bad behaviour like non compliance with orders. Do you have a solicitor?

Thanks for your help. No solicitor sadly. I've no money, but despite dv don't qualify for legal aid due to value of equity in property. Which ironically I can't borrow against without his permission. I've had support from ncdv re my other orders, but need to do the divorce on my own, he point blank refuses to cooperate.

Yes I've got my nisi. I need to do finances now but have gotten stuck because of no cooperation. It's the last control he has over us.
