Broken recitals immediately

I just deleted my post because it was so long. Trying to be to the point here, ex and I have just got new court order two weeks ago. I have residency of Ds. Ex had a prohibitive steps against him which has just been removed after two years.

The court order has lots of recitals stating what is ex will and won't do. Within two weeks he's broken several of them.

My barrister (direct access) said at last hearing that if things don't go as expected either I apply back to vary the order or I refuse contact (with grounds), he takes me back for breach and I defend it.

I haven't made any moves yet but it is clear that ex is going to just use court order as he sees fit and ignore it when he doesn't.

What can I do? It probably needs all the essay I wrote to make sense of this. Sad

I would either write or email him aayingbtgat on such and such date you did this in contravention of the court order and that you hope he will stick tho the order in future.

This way you will document the breaches and it will keep a record and show breaches if you do decide at some point to stop contact and defend any application he may make.

Wow I must be tired because I didn't even notice the gobbledegook word until you pointed it out!

That is a good point and will mention the other contraventions in next email. There is a pressing issue with holiday contact at easter though. Didn't really want to lay out ins and outs here as it's long but basically he clearly isn't going to do what we agreed.

Have you had a name change fail? Is that important to you? If so, report your thread so MNHQ can delete it Smile I agree with Allthebest, keep a paper trail from day one.
