Assault.. Witness.. Child witness.

So dp recieved his court date for the accusations of assault in his ex.. For next month. That's fine as he knows he's not guilty.
However she since has tried to say that one of the dcs were stood next to her to make it sound worse. ! Wtaf? All it was was an argument..

So he has said then he would call the child as a witness.
.how would he go about it? Now that the date is already set?

For fucks sake they both need to leave the child out of it. XH could have been convicted for one of many assaults on me because DS1 witnessed it, but why would I have put my child through the ordeal of court?

He needs legal advice, but dragging a child to court isn’t on.

Yes I get that totally. However why should he potentially be punished or fined in anyway if not guilty!
He has got a solicitor who said to think about whether to call the dc as a witness. As theynwoukd do it through play, and the dc wouldn't know what it's for..
His solicitor is away until 2 days before court now which is a pain

To avoid the child having to be in court there is a child advocacy service which means an independent advocacy worker can come and speak to the child either at home or in school. It would be a lot less stressful for the child.

As he has now told his ex that he will call the child as a witness you run the risk of her being manipulated by the mother

He's definitely not guilty. I wouldn't be with someone of they had that in them.due to previous DV years ago.
But I wouldn't put it past her to mark herself as ' evidence'

Even recently in family court for the dcs they could see she was being outright awkward and told her to stop messing about.

So hopefully they will see this time too.

She's needs to. Grow up and stop being so jealous that dp has moved on years later. As this is what it boils down to.

I'm a lawyer and always caution clients carefully if they were insisting on bringing child witnesses to criminal trials as defence witnesses.
