When will court date be scheduled?

I think my ex is going to try to go back to court before Christmas to change the existing arrangements for contact over Christmas. Not going to go into the detail but he's been abusive and controlling since we were together and refuses to make suitable arrangements for the holidays. We've already been to court twice before.

If he applies now how soon would the court date be scheduled for? Last time I'm sure it took about 5 weeks but I know there's such a thing as an emergency order.

It feels like Christmas will be here before I can make plans.

Googling seems to confirm it would probably be very close to Christmas. He has talked about making an agreement in the past and then sprung court on me out of nowhere so I just don't know what's going on. It's all a ploy to cause as much stress as possible.

Probably not before Christmas. I had a case this week where the next court date free was early January.

I had 2 new cases last week both come back listed for 11 December, so some courts still have space.

If there is an existing order, OP, you stick with that until something else is ordered.

I'm happy to stick with the current order but it still requires us to make certain arrangements ourselves, which he won't do. I don't want to go to court just before Christmas meaning I can't arrange anything beforehand Sad. He's asking for an arrangement which isn't fair so it's unlikely he will win. He didn't last time, but I can't know for sure.

Hard to advise without knowing more, then. It seems pretty unlikely he'll get in before Xmas, unless you head in the next few days.
